U.S. DOT ISSUES FINAL RULE ON ORAL FLUID TESTING

The USDOT has amended its drug & alcohol testing regulations to add oral fluid as an authorized testing method for the presence of prohibited drugs.  The Final Rule was published in the Federal Register on 05/02/2023 – Final Rule (Effective 06/01/2023). Note: Employers cannot begin oral fluid testing until the Department of Health and Human Services has certified at least two laboratories for oral fluid testing; currently, there are no laboratories that have been certified to perform oral fluid testing. So, although the Final Rule makes the necessary regulatory revisions to allow for oral fluid testing, such tests are not yet authorized.

WFQA is reviewing the final rule, which has many changes from the proposed regulations and will advise clients as further information becomes available.
